Terms of Service

These terms are the agreement between your restaurant and us for the use of Ordo. They are written plainly on purpose. By signing up for Ordo, connecting your WhatsApp number, or using the service, you accept them.
1. Who these terms are between
"We", "us" and "Ordo" mean AFLATUS OPC PVT LTD, a company incorporated in India. "You" means the restaurant business that signs up for Ordo, and anyone you allow to use it on your behalf.
If you are agreeing to these terms for a business, you confirm you are authorised to bind that business.
2. What Ordo does
Ordo answers messages sent to your restaurant's WhatsApp number and takes delivery orders from your customers on your behalf. It shows your menu, records quantities, captures a delivery address and location, calculates the total using the prices and fees you gave us, alerts your staff, and records each order in a spreadsheet you can access.
Ordo does not cook, deliver, or take payment. Every order is cash on delivery. The contract to supply food is between you and your customer — Ordo is only the means by which the order reaches you.
3. What you are responsible for
- Your menu and prices. Ordo repeats exactly what you give us. If a price is wrong in your list, it will be wrong in the customer's order. Keep it current and tell us when it changes.
- Fulfilling orders. Preparing the food, delivering it, food safety, hygiene, allergen information and any licences you need are all yours.
- Your customers. Answering complaints, giving refunds, and dealing with anything that goes wrong with an order.
- Your WhatsApp account. Keeping your Facebook Business Manager and WhatsApp Business account in good standing, and complying with Meta's own policies, including the WhatsApp Business Messaging Policy. If Meta restricts or bans your number for something you did, we cannot undo it.
- Lawful use. Not using Ordo to send unsolicited marketing, to message people who have not contacted you, or for anything illegal.
- Accurate setup information. The opening hours, delivery fee, minimum order and staff alert number you give us.
4. What we are responsible for
- Setting Ordo up for your restaurant and handing it over working.
- Loading your menu, prices and rules as you supplied them.
- Making a reasonable effort to keep the service running and to fix faults promptly.
- Handling your data, and your customers' data, as described in our privacy policy.
Support is provided over WhatsApp and email at info@aflatus.com. We aim to respond within one working day. Menu, price and opening-hours changes are made for you on request.
5. Fees and payment
Ordo is charged as a one-time payment of ₹20,000 (Indian rupees) rather than a monthly subscription. That fee includes setup and 50,000 messages per year.
For the purpose of this clause, a "message" means each individual WhatsApp message sent or received on your connected number through Ordo. The allowance runs for twelve months from the date your number goes live and does not carry over.
If you are outside India, we will quote the equivalent fee in your local currency before you sign up.
If you approach the 50,000 message allowance, we will contact you to agree how to continue before the service is affected.
The fee is exclusive of any applicable taxes, which are added where the law requires. Any per-conversation charges that Meta levies for WhatsApp Business Platform traffic are billed by Meta and are not included in our fee.
Fees are payable in advance of setup unless we agree otherwise in writing.
6. Availability, and what we do not promise
We want Ordo to be running whenever your kitchen is. But Ordo depends on services we do not control — WhatsApp and Meta's platform, Google, our hosting provider, and your own internet connection. We do not promise uninterrupted or error-free service, and we do not offer a guaranteed uptime figure.
Ordo follows fixed rules rather than artificial intelligence, so its replies are predictable. It is still software, and it can be affected by an outage upstream, a misconfigured menu, or a message format it does not recognise. You should keep the ability to take orders by hand.
7. Suspension
We may suspend the service, with notice where practical, if:
- a payment due to us is overdue;
- Meta suspends or restricts the WhatsApp account involved;
- we reasonably believe Ordo is being used unlawfully, or to send unsolicited messages; or
- we need to protect the service or other customers from harm.
8. Who owns what
Ordo — the software, its logic, its design and this website — remains ours. You are given the right to use it for your restaurant for as long as this agreement lasts, and no more. You may not copy it, resell it, or attempt to rebuild it from what you can observe.
Your menu, prices, business name, logo and your customer records remain yours. You give us permission to use them only to run Ordo for you.
We will not name your restaurant, or use your logo, in our own marketing without asking you first.
9. Limits on our liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for:
- lost profits, lost sales, lost orders, or lost goodwill;
- orders missed while the service, WhatsApp or your own connection was unavailable;
- the consequences of incorrect menu or price information you supplied;
- anything arising from your relationship with your own customers, or from the food you serve.
Our total liability to you, for any and all claims taken together, is limited to the total fees you have paid us in the twelve months before the claim arose.
10. Ending this agreement
You can stop using Ordo at any time, and you can disconnect it from your WhatsApp account yourself through your Facebook Business settings.
We may end this agreement if you materially breach it and do not put it right within 14 days of us telling you.
When the agreement ends, we stop answering messages on your number. Your order records remain in your spreadsheet, which stays yours. On request we will delete the data we hold, as described in our data deletion page.
Because the fee is a one-time payment covering setup and your first year's message allowance, it is not refundable once we have begun setting up your account. If we end the agreement ourselves for a reason that is not your fault, we will refund a fair proportion of the fee.
11. Changes to these terms
We may update these terms. If a change materially affects you, we will tell you using the contact details we hold, and the "Last updated" date above will change. Continuing to use Ordo after that means you accept the updated terms.
12. Governing law
These terms are governed by the laws of India, and the courts of India shall have jurisdiction over any dispute. If you are outside India, this does not remove any protection you have under the mandatory consumer or commercial laws of your own country.
13. WhatsApp and Meta
Ordo uses the official WhatsApp Business Platform. Ordo is an independent product and is not affiliated with, endorsed by or sponsored by Meta Platforms, Inc. WhatsApp is a trademark of Meta Platforms, Inc. Your use of WhatsApp is also subject to Meta's own terms, and Meta may change its platform, pricing or policies in ways that affect Ordo and that are outside our control.
